The court has ordered to send the expelled president of Dhaka Metropolitan South Juba League Ismail Hossain Chowdhury Samrat to jail in a case filed by the ACC on the charge of acquiring non-income assets.

On Tuesday (May 24), Dhaka Special Judge Court-6 Judge Al Asad Md. Asifuzzaman’s court gave the order.

Earlier, he appeared in court and surrendered through a lawyer, and applied for bail. On the other hand, the ACC lawyer opposed his bail. After hearing both sides, the judge ordered that he be sent to prison. At the same time, he fixed June 9 for the bail hearing.

On Wednesday (May 16) the case of the emperor’s bail was canceled by the High Court Justice. Nazrul Islam Talukdar and Justice Kazi Mohammad. Bench of Izarul Haque Akand. He was also ordered to surrender to the court within seven days.

Senior lawyer Mansurul Haque Chowdhury appeared for the emperor in the court on that day. Advocate Khurshid Alam Khan appeared for the ACC.

After the order, Advocate Khurshid Alam Khan said that the High Court had said in the order that the judge did not judge the merits of the case but only granted bail on medical grounds. The judge granted the bail on the basis of two early medical reports in 2020 and 2021 and wrote at the end that the report should be submitted on June 9.

The ACC lawyer said, “Our argument was that if anyone wants to bail on medical grounds, the judge should call the medical report, review the report and listen to both the parties.” Then the court will decide whether to grant bail or not. But the judge added ‘cars before horses’. This is exactly what the High Court has observed in the order. ‘

Khurshid Alam Khan said that before granting bail, the judge should have seen the report of the medical board till June 9 and considered his bail, then considered or rejected it. But that deviation happened there.

Besides, there are some conditions of bail in Section 13 of the Prevention of Money Laundering Act, the ACC lawyer said, adding that he (the judge) did not abide by those conditions. The court warned the judge not to make such a mistake in the future.

The emperor’s lawyer, Advocate Munsurul Haque Chowdhury, said the High Court had canceled the emperor’s bail due to a slight error in the lower court’s order. The emperor is still ill, I told the court he was admitted to the CCU of the hospital. I will surrender to the court at the medical ground and apply for bail again.

Last May 11, Dhaka Special Judge Court-6 Judge Al Asad. Asifuzzaman granted bail to the emperor in an ACC case alleging illegal acquisition of assets. His lawyer said there was no impediment to his release as there were no more cases against the emperor after he was granted bail in a case of illegal acquisition of wealth after arms, drug, and money laundering cases.

A case filed by the ACC against the emperor on November 12 of that year alleging the acquisition of non-income assets was alleged to have resulted in the acquisition of illegal assets worth Tk 2.94 crore. The next year, on November 26, 2020, the ACC filed a charge sheet in the court. In the charge sheet, it was alleged that the emperor had acquired 222 crores 8 lakh 82 thousand 493 takas of known non-income assets.
